Terms and Conditions of Ticket Purchase and Event Participation

Company: ARC Game Design, operating under the name Spirits of NYC

By purchasing a ticket to and/or participating in any event produced by ARC Game Design ("the Company", "we", or "us"), operating under the name Spirits of NYC, you ("you", "participant", or "attendee") agree to the following Terms and Conditions:

1. Event Description

Spirits of NYC events are immersive outdoor experiences that involve walking through public and/or semi-public spaces in New York City while engaging in a narrative game that may include interaction with live actors and the use of game books or other materials provided by the Company.

2. Assumption of Risk

By participating, you acknowledge that:

  • The event takes place in an uncontrolled urban environment.

  • You may encounter uneven surfaces, vehicular traffic (including bicycles and scooters), adverse weather conditions, pedestrians, citizens with mental health challenges, and other potential hazards.

  • You voluntarily assume full responsibility for any risk of injury, property damage, theft, loss, illness, or death that may occur before, during, or after the event, regardless of cause.

3. Release of Liability

To the fullest extent permitted by law, you agree to release, waive, and hold harmless ARC Game Design, Spirits of NYC, its owners, employees, contractors, affiliates, performers, volunteers, and partners from any and all claims, demands, losses, damages, or legal actions arising out of or related to:

  • Personal injury, illness, or death;

  • Damage to or loss of personal property;

  • Any interactions with third parties, including other attendees, members of the public, or law enforcement;

  • Acts or omissions of actors or staff during the event.

4. Health & Physical Requirements

Participants should be in suitable physical condition to walk for extended periods and navigate city streets. If you have any medical conditions, mobility issues, or concerns about participating, please consult a healthcare provider before attending.

5. Behavior and Conduct

You agree to:

  • Respect all instructions given by Company staff and performers.

  • Behave responsibly and safely during the event.

  • Not harass or endanger actors, staff, other attendees, or members of the public.

  • Follow all applicable local laws, including traffic and pedestrian rules.

The Company reserves the right to remove any participant from the event without refund for behavior deemed unsafe, disruptive, or inappropriate.

6. Weather Policy

Events proceed rain or shine unless deemed unsafe due to severe weather or other unforeseen circumstances. In the event of cancellation, ticket holders will be offered a reschedule. If no other available times work for you, the Company will issue a refund from Eventbrite within 3-5 business days, minus Eventbrite fees.

7. Photography and Media Release

By attending, you grant the Company the right to photograph, film, or record you during the event and to use your likeness for promotional, commercial, and archival purposes without compensation.

8. Refunds and Transfers

All ticket sales are final. No refunds will be issued unless the event is canceled by the Company. Ticket date/time transfers are permitted via Eventbrite up to 3 days before your scheduled purchase.

9. Intellectual Property

All content, game materials, scripts, character portrayals, and other intellectual property provided or performed during the event are the sole property of ARC Game Design and may not be copied, recorded, distributed, or reused without prior written consent.

10. Indemnification

You agree to indemnify and hold harmless the Company and its representatives from any liability, claims, or demands resulting from your actions during the event, including damages or injuries caused to yourself or others.

11. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

13. Acknowledgment

By purchasing a ticket and participating in this event, you confirm that you have read, understood, and agreed to these Terms and Conditions.
